AN ACT MAKING AN ADDITIONAL APPROPRIATION OF SPECIAL FUNDS TO THE GOVERNOR'S OFFICE - DIVISION OF MEDICAID FOR THE PURPOSE OF REIMBURSING THE DEPARTMENT OF MENTAL HEALTH FOR ITS STATE OWNED NURSING FACILITIES ON A FULL REASONABLE COSTS BASIS AS REQUIRED UNDER SECTION 43-13-117(4)(c) AND (12)(b), FOR FISCAL YEAR 1999.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Governor's Office - Division of Medicaid which is comprised of special source funds collected by or otherwise available to the commission, for the purpose of providing medical assistance under the Mississippi Medicaid Law and defraying the expenses of the administration of such law, for the fiscal year ending June 30, 1999 $ 7,666,000.00.

SECTION 2. This additional appropriation is made for the purpose of providing the budget spending authority for the Governor's Office - Division of Medicaid to make reimbursement to the Department of Mental Health for services provided during fiscal year 1998 by its state owned nursing facilities on a full reasonable costs basis as required under Section 43-13-117(4)(c) and (12)(b). It is the intention of the Legislature that the Governor's Office - Division of Medicaid shall make payment to the Department of Mental Health no later than April 15, 1999, for the full amount of funds appropriated in this act.

SECTION 3. The money herein appropriated shall be paid by the State Treasurer out of any money in the State Treasury to the credit of the Governor's Office - Division of Medicaid, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the Director of the Division of Medicaid, as authorized by Section 43-13-113, Mississippi Code of 1972.

SECTION 4. This act shall take effect and be in force from and after its passage.
